Welcome to Pharmadiv (Pty) Ltd. By accessing or using our website, products, or services, you agree to these Terms & Conditions in full. If you do not agree, you must not use this website or place any orders.

📌 Definitions

• “We”, “us”, “our” refer to Pharmadiv (Pty) Ltd

• “You”, “your” refer to the user, customer, or client using this website and/or placing an order

• “Goods” means products purchased from Pharmadiv

• “Delivery” means delivery to the address you provided at checkout

⚖️ Legal Framework (South Africa)

We operate in line with South African consumer law, including:

• Consumer Protection Act (CPA)

• Electronic Communications and Transactions Act (ECTA) (online purchase cooling-off rules, where applicable)

Nothing in these Terms limits your rights where the law says it may not be limited.

🔁 Refund & Return Policy Summary

1) 🚚 Damaged / Incorrect / Missing Items (Delivery Issues)

• If your order arrives damaged, incorrect, or missing items, please notify us within 48 hours of delivery, ideally with clear photos. 📸

• If we were at fault, we will arrange a replacement or refund at no cost to you.

2) 🛠️ Defective Goods (CPA)

If goods are defective, unsafe, or not fit for purpose, you may return them within 6 months of delivery (subject to assessment), and you may choose repair, replacement, or refund where the CPA applies.

3) 😅 Changed-My-Mind Returns (Buyer’s Remorse)

We accept eligible changed-mind returns under the rules below:

You may request a return within 30 days of delivery if the item is:

• unused / unopened (where applicable),

• in original packaging,

• complete with all accessories, manuals, and parts,

• in a re-sellable condition.

Changed-mind return costs:

• Return shipping / collection is for your account (unless we were at fault).

• Original delivery fees are not refundable for changed-mind returns.

4) 🚫 Non-Returnable Items (Changed-My-Mind)

For safety and hygiene reasons, the following are generally not returnable if opened/used (but may still be returnable if defective/incorrect/damaged, where the law applies):

• medicines and pharmacy consumables 💊

• vitamins, supplements, ingestibles 🧴

• personal care, cosmetics, hygiene products 🧼

• sterile or sealed medical items once opened 🩺

• items that expire quickly or can’t be returned by their nature

5) 💳 Refund Timing & Method

• Refunds are processed once a week (usually Tuesdays) 🗓️

• Refunds are made back to the original payment method where possible.

• If a refund must be handled manually (e.g., EFT refunds), we may request supporting info (proof of payment, banking details, ID, etc.) to prevent fraud.

📦 Product Availability & Accuracy

• We sell a large catalogue (10,000+ items), so product images may sometimes be stock photos and not always 100% accurate.

• If an item is out of stock, discontinued, or delayed by a supplier, we may:

  1. backorder it,

  2. offer a substitute, or

  3. offer a refund / store credit —
     depending on what you prefer and what is practical.

🚚 Delivery & Shipping

• We aim to use your chosen shipping method, but we reserve the right to use an alternative courier if parcel size, risk, or value requires it.

• Estimated delivery time is 5 to 15 business days (from dispatch). 📦⏱️

• Orders are only dispatched once payment is confirmed in full.

• Pharmadiv is not responsible for delays caused by couriers, incorrect addresses, restricted access, or inability to reach you.

💰 Payments

We accept Visa, Mastercard, PayFast, Payflex, HappyPay, Float, EFT, and other verified gateways. Orders are only processed and dispatched once payment is confirmed.

🏷️ Pricing & Errors

• Prices may change without notice.

• If an incorrect price is displayed due to an error, we may cancel the affected order and refund you.

• Promotions and discounts may be limited by time, stock availability, or supplier constraints.

🧾 Account Credit & Balances

• If we issue store credit, it is your responsibility to track and use it.

• If you do not have a Pharmadiv account, email finance@pharmadiv.co.za for refund arrangements.

🩺 Product Use & Liability (Health Products)

Pharmadiv is a supplier and not a prescriber. Use all health-related products according to manufacturer instructions and/or advice from a qualified healthcare professional. We are not liable for harm caused by misuse, self-prescribing, or use contrary to instructions.

🧑‍💻 Use of Our Website

You agree not to:

• misuse the site,

• attempt to hack, scrape, or manipulate product data,

• place fraudulent orders,

• impersonate others,

• abuse staff or support channels.

We reserve the right to block users, cancel orders, or refuse service where abuse or fraud is suspected.

🧠 Intellectual Property

All website content (text, images, logos, software) is the intellectual property of Pharmadiv (Pty) Ltd or its suppliers/licensors. Unauthorized copying, use, or redistribution is prohibited.

⚠️ Limitation of Liability

We do our best to keep the website running smoothly, but we do not guarantee uninterrupted access. To the maximum extent allowed by law, we are not liable for indirect loss or damages resulting from use of our site or products, including courier delays, supplier delays, or order cancellations.
